Terms and Conditions

(please read these terms and conditions carefully as they contain very important information about booking a travel product and/or service with Lakay Experiences) 

When you book a travel product and/or service with Lakay Experiences to a destination, you expressly accept these Terms and Conditions, without modification, intend to be legally bound by them and acknowledge and agree that they become part of your contract with Lakay Experiences.

Lakay Experiences acts only as an agent for you in relation to travel services and/or products purchased by you including, but not limited to, accommodations, transportation [including, but not limited to, ground and air transportation], and tours.  

All of these travel services and/or products purchased by you and provided in your itinerary are furnished by travel suppliers over which Lakay Experiences and its agents exercise no control. Although Lakay Experiences has taken reasonable steps to ensure proper arrangements are in place for your travel plans, we cannot be held responsible for the acts or omissions of such independent contractors, any claims, losses, damages, costs or expenses arising out of personal injury or death, loss, damage or delay of baggage or other property, delay, loss of enjoyment, inconvenience, upset, disappointment, distress or frustration whether physical, emotional or mental, resulting from or arising out of any of the following:

Any act or omission (including, but not limited to, inability or failure to provide services and/or products) by any customer, supplier or third party including, but not limited to, the airlines, transportation companies, coach tour operators, car rental organizations, excursion providers, hotel/resort properties, or anyone for whom such suppliers or third parties may be in law responsible;

An act of God or Event of Force Majeure;

Equipment failure;

Sickness/illness (including, but not limited to, contracting food-borne illnesses, viruses, diseases, etc.), family emergencies, theft or any other circumstance affecting you beyond our direct control;

Failure of the passenger to obtain the necessary documentation or meet the required health regulations in order to complete their travel arrangements;

Failure of the passenger to follow instructions including, but not limited to, airport departure times, baggage handling and check-in time frame stipulated by Lakay Experiences in these Terms and Conditions on the day of departure whether due to missed connections, adverse weather conditions, mechanical failures or any other reason whatsoever; voluntary participation in an optional tour, excursion or activity;

The need for us to cancel services, change itineraries or substitute accommodation or services, provided that efforts are made to supply comparable services and accommodations available; or


Cancellation of an optional tour, excursion or activity.


Pricing and Payments:

Prices quoted by Lakay Experiences are in United States Dollars and are based on costs at the time of the quote. The package price, as indicated on the itinerary may include a flight, as well as applicable airfare taxes, except for departure tax at some destinations. Other tour services and accommodations are included in your package price only if they are indicated on your itinerary. Quoted rates are based on prices at time of purchase and are subject to change without notice due to currency fluctuations or additional government taxes or fees beyond our control. We make every effort to honor the package price initially quoted and advise travelers of any price changes immediately. You may incur additional expenses that are not included in your package price, including but not limited to resort fees, destination taxes and environmental fees.

Pricing and space is not guaranteed until a reservation is secured with a payment. If deposit is not received within the required timeline outlined in your booking form, your reservation will be canceled. If final payment is not received within the allotted time frame, the reservation will be canceled and no monies will be refunded.

Price match is only available within 24 hours of booking (once deposit or full payment is processed).


Foreign Transaction Fees:

Lakay Experiences is not responsible for foreign transaction fees that may be imposed by your credit card provider.



Cancellation, revision and refund policies for changes or unused travel/components vary and are subject to the policies of each travel supplier. Cancellation penalties can range up to one-hundred (100%) depending on how close to departure the written notification is received from you. Issued air, insurance, and no-shows are always non-refundable.  reserves the right to charge a fifty ($50) dollar per person administrative fee payable before cancellation requests are to be processed. 


Air Travel:

Flight details including departure times are always subject to change by the airlines and are not under the control of . It is your responsibility to check in for your flight twenty-four (24) hours before departure and confirm arrival and departure instructions, including gate/terminal information, check-in locations and flight times. It is also your responsibility to arrive at the airport on time and following check-in to proceed to the correct departure gate by the time specified on your boarding pass.  will not provide refunds or compensation for unused seating upgrades or provide any compensation as a result of a passenger being denied boarding. Should you be denied travel, it is your responsibility to make alternate arrangements.  cannot be held responsible if you miss your flight by failing to comply with these requirements.

Once issued, airline tickets are non-refundable and name changes are not permitted. Date changes may be permitted with a fee plus any difference in the fare. Routing restrictions may apply. Airlines may have additional fees for seat assignments, premium seat assignments and for checked luggage. Frequent Flyer miles may not be available for accrual with certain discounted tickets.

Name(s) on airline ticket(s) must be an exact match to the name(s) on government issued identification and/or passports. 

Should you wish to book your own flight(s), all flight reservations, including connections, are made at your risk and you assume the cost of any loss in the event of a change to the flight arrangements that may require you to change your connecting flight(s).  cannot be held liable for damages or additional fees incurred by passengers due to a missed flight connection for whatever reason.

 does not accept responsibility for lost wages, missed vacation time or any other additional expenses incurred as a result of changes in flight times.



Hotel reward points or amenities may not be combinable with all hotel packages. 

Covid-19 Provision: As the health and well-being of guests and staff are a hotel's top priority, precautionary actions may be taken by the hotel during your stay (including, but not limited to, compliance with all governmental agencies or entities' directives, orders, regulations, guidelines and/or advisories, use of social distancing and/or masks, temperature screening, reduction in amenities, immediate disclosure to the hotel of symptoms and/or knowledge of possible infection, personal hygiene, self-isolating and quarantining and any other orders or directives issued by the service provider or any applicable agencies or entities of any federal, provincial, state or local governments) to prevent exposure to illnesses, viruses and/or diseases. You agree that you must follow all such health and safety measures. We strongly recommend that you contact the hotel directly for the most up-to-date information prior to your arrTravel



It is your responsibility to ensure proper documentation is readily available for your trip. This includes but is not limited to government issued identification (domestic travel), valid passport (international travel) or entry visa (required for several countries). Any and all additional Visas or travel documents required are your responsibility. Travelers are advised to call us or visit for assistance in obtaining a visa(s) for their trip. 

Passengers traveling outside the United States are required to carry proof of citizenship. All U.S. citizens must have a valid U.S. passport. The passport must be valid for six months after the return date of your travel. Passport cards are not valid for travel to Mexico and the Caribbean. 

Minors: Minors age seventeen (17) and younger traveling alone or with a single parent may be required to have additional documentation on international flights. It is your responsibility to secure the current requirements for your particular itinerary and carrier. 

Vaccinations: The country you're traveling to may require proof of vaccinations. Without proper vaccinations, you may be denied entry into the country. We recommend that travelers contact the Center for Disease Control or their health provider for specific vaccinations and timely updates for other health news.  will not be liable for your failure to meet the required health regulations. 

Criminal Record: A previous criminal record could be an obstacle in international travel. If you’ve ever been convicted of a crime, you may be denied entry into your destination country. It is your responsibility to determine entry requirements and restrictions before proceeding with your travel reservation.  


Lakay Experiences will not be liable for passenger(s) denied boarding, entry or re-entry due to lack of proper documentation and such passengers will not be entitled to a refund.


Travel Insurance: 

Lakay Experiences strongly recommends the purchase of Travel Protection that can help minimize the monetary loss incurred due to unforeseen events beyond your control such as: cancellation, missed connections, baggage loss, trip delay, and medical emergencies. Without travel insurance, your vacation investment may be non-refundable and subject to change/cancel fees of up to 100% without exception.


Risks and Safety: 

Travel to certain destinations may involve greater risk than to other destinations.  urges customers to remain informed on a daily basis as to current news, as well as to review travel prohibitions, warnings, announcements and advisories issued by the United States Government prior to booking travel to international destinations. Information on conditions in various countries and the level of risk associated with travel to particular international destinations can be found at,,,, and   

The Smart Traveler Enrollment Program (STEP) is a free service, provided by the U.S. Government to U.S. citizens who are traveling to, or living in, a foreign country. STEP allows you to enter information about your upcoming trip abroad so that the Department of State can better assist you in an emergency. Registration is recommended and provided by going to 

By selling travel to particular destinations,  does not represent or warrant that travel to such points is advisable or without risk, and shall not be liable for costs, damages or losses that may result from travel to such destinations. Decisions of when and where to travel are made by the customer alone. A customer’s use of  and its services is solely made by the customer and constitutes acceptance of such events at customer’s own risk.

Intellectual Property: (the “website”) contains material, such as videos, photographs, software, text, graphics, images, sound recordings, and other material provided by or on behalf of  (collectively referred to as the “Content”). The Content may be owned by us or third parties. The Content is protected under both United States and foreign laws. Unauthorized use of the Content may violate copyright, trademark, and other laws.

No Content from may be modified, copied, reproduced, republished, downloaded, posted, displayed, transmitted, performed, licensed, used to make a derivative work, transferred, sold or distributed in any way, without prior written consent from  You may not frame or mirror any Content on any other server or other location. The unauthorized use or posting of the Content on any other website, social media page, or in a networked computer environment for any purpose is expressly prohibited.


These Terms and Conditions are binding upon all customers included in the itinerary and such customer's family, dependents, estate, heirs, successors and legal personal representatives.

In the event any paragraph of these Terms and Conditions shall be declared invalid or void by any court, such declaration shall not invalidate the entire agreement and all other paragraphs of these Terms and Conditions shall remain in full force and effect.

The parties agree any claim or litigation arising out of or relating to these Terms and Conditions, or the breach or validity thereof, shall be brought in New York County, New York, and the governing law shall be the laws of the State of New York. You agree that in the event that any civil proceeding, arbitration, mediation or action of any kind, is commenced by you against  the limit on any damages [which includes but is not limited to damages, interest, court costs, attorney fees, expenses of litigation, and punitive damages] shall be the amount you paid  and/or the travel supplier for the services which is the subject matter of these Terms and Conditions.


Reservation of Rights:
Lakay Experiences reserves the right, in our sole discretion, to change, suspend, or discontinue all or any part of these terms at any time without prior notice or liability. Updated versions of these terms are posted on our website,, and sent to clients with their booking forms. These terms and conditions are effective immediately after posting on the website and upon sending to clients. Use of the website and/or our services constitutes acceptance of these conditions. 



By making a reservation to purchase a vacation product from , you, the customer/passenger, hereby acknowledge that you have read and accept the Terms and Conditions contained herein. You also confirm that as the booking or instructing passenger, you have the legal capacity and authority to book travel services on behalf of yourself and of other persons named in the invoice and itinerary.
